Therefore, these Privacy Policies are intended to inform you of the type of information we collect from you, how such information is handled, and, where appropriate, shared. As a Valvoline User, you should be assured that your personal data will be protected. The security of your personal information is our priority; that is why we protect this information by maintaining physical, electronic, and procedural safeguards, training our employees in the proper handling of your personal information, in order to prevent unauthorized third parties from accessing it. The Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”) contains all the provisions we must comply with to protect your personal data. By virtue of the foregoing, we inform you that in compliance with our Privacy Policies and the Law, the personal data we obtain as a result of the operations you request or enter into with Valvoline will be treated confidentially through the systems established for such purposes.
PERSONAL DATA WE COLLECT FROM YOU: Valvoline will collect the identification, employment, asset, credit, financial, and social network data necessary for the formalization of the services you request or require; by way of example, but not limited to, Valvoline may collect your name; address; date of birth; place of birth; nationality; occupation, profession, activity, or business line to which you are engaged; telephone numbers; Unique Population Registry Code; Federal Taxpayer Registry code, Facebook account, email account, and LinkedIn account. Likewise, Valvoline may require additional data, using an analysis of such information.
PURPOSES OF PROCESSING YOUR PERSONAL DATA: The personal data that Valvoline collects will be used for the operation and registration of the services and may be used for the purposes that, by way of example but not limited to, are listed below: a) Confirm the identity of its Users; b) Verify the service history of its Users; c) Prevention against Money Laundering and the commission of illegal acts in general; d) For collection of requested services; e) For advertising and promotion of services offered by Valvoline; f) For statistics; and g) In general, to comply with the processes and documents related to the provision of services by Valvoline.
DISCLOSURE OF PERSONAL DATA. Valvoline may transfer your personal data to Mexican or foreign third parties that provide necessary services for its proper operation. In such cases, we inform you that Valvoline will take the necessary measures to ensure that persons who have access to your personal data comply with Valvoline's Confidentiality and Data Privacy Policy, as well as with the principles of personal data protection established in the Law.
CONSENT FOR DISCLOSURE OF PERSONAL DATA. Valvoline Users may at any time request that Valvoline cease the use and handling of their information. Valvoline undertakes to respond to your request as soon as possible; however, depending on the circumstances of each case and the services we are providing you, the process may take time. ARCO RIGHTS: You or your duly accredited legal representative may limit the use or disclosure of your personal data and may exercise, when appropriate, the rights of access, rectification, cancellation, or opposition provided for by the Law by submitting a request at the address indicated above. It is important to mention that the exercise of any of these rights is not a prerequisite nor does it prevent the exercise of another of these rights. Likewise, we inform you that you have the right to initiate a Data Protection Procedure before the Federal Institute for Access to Information and Data Protection (www.inai.org.mx) within 15 days following the date you receive Valvoline's response or from the expiration of the 20-day period from the date of receipt of your request to exercise rights.
CHANGES TO THE PRIVACY NOTICE: Any modification to this notice will be notified to you through any of the following means: a written communication sent to your address; a message contained in your account statement; a message sent to your email or mobile phone or any electronic means you use to conduct transactions with Valvoline.
JURISDICTION: The location of the User does not exempt compliance with these Terms and Conditions, regardless of their place of residence or the place of execution of the application. The language governing these Terms and Conditions in the event of any dispute will be Spanish. For any dispute arising in connection with Valvoline from these Terms and Conditions, at Valvoline's option, it will decide (i) to submit to the Jurisdiction of the Courts of the city of San Luis Potosí, with the parties hereby waiving any jurisdiction that may correspond to them by reason of their present or future domiciles, or for any other reason, or (ii) to attempt to reach a settlement or solution through mediation, which will be administered by the Mediation Center of San Luis Potosí and its rules; in the event that no mediation agreement is reached within 60 calendar days following the written or email notification of mediation, disputes must be definitively resolved in accordance with the arbitration rules of the Arbitration Center of Mexico (CAM) by an arbitrator appointed in accordance with said regulations, the place of arbitration always being San Luis Potosí, the applicable substantive law being the current Mexican law and the language being Spanish; and (iii) if the dispute is brought by THE USER, it will always and only proceed in accordance with point (ii) above.
